Where it stands

Judge John R. Tunheim's February 13, 2025 order let only Count 1 (breach of contract) and Count 2 (breach of the implied covenant of good faith and fair dealing) proceed, on the theory that the plans promised clinician-made coverage decisions. Counts 3 through 7 — unjust enrichment, insurance bad faith, Oregon negligence per se, Minnesota unfair and deceptive insurance practices, and California UCL — were dismissed WITH PREJUDICE. Reconsideration was denied June 2, 2025. On March 9, 2026 the court ordered broad class-wide discovery into nH Predict over UnitedHealth's objections. No class-certification motion has been filed; under the May 21, 2026 schedule fact discovery closes March 11, 2027 and trial readiness is December 6, 2027.
